Terms And Conditions Welcome to ProofVibe.com (“ProofVibe,” “we,” “our,” or “us”), a social proof SaaS platform based in Maharashtra, India. These Terms and Conditions (“Agreement”) govern your use of our website, services, and software (collectively, the “Service”). By accessing or using the Service, or by clicking a button or checking a box marked “I Agree” (or similar), you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, you may not use the Service.

ProofVibe reserves the right to modify these terms at any time. We will notify you of any changes as described below. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

Please read this Agreement carefully. It includes a mandatory arbitration provision and a waiver of class actions and jury trials.

  1. ProofVibe Service 1.1 Eligibility This Agreement is a contract between you and ProofVibe. You may use the Service only if you can form a binding contract with ProofVibe and comply with this Agreement and all applicable laws. The Service is not available to anyone under 18 years of age or Users previously removed by ProofVibe.

1.2 Limited License Subject to this Agreement, ProofVibe grants you a non-exclusive, limited, non-transferable, revocable license to use the Service. ProofVibe reserves all rights not expressly granted.

1.3 User Accounts You are responsible for maintaining the security of your account and all activities under it. You must provide accurate information and notify us immediately of any unauthorized use. By signing up for an account on ProofVibe, you consent to receive service-related notices and marketing communications, including future newsletters and promotional emails. You can opt out of marketing emails at any time.

1.4 Service Rules You agree not to:

  • Use the Service for illegal, harmful, or abusive purposes.
  • Violate any intellectual property rights or privacy laws.
  • Attempt to gain unauthorized access to the Service or other accounts.
  • Use the Service to harass, defame, or discriminate against others.

You represent that:

  • You have the rights to the User Content.
  • It does not violate any laws or third-party rights.
  • It is accurate and truthful.

ProofVibe is not responsible for User Content or its consequences.

  1. Customer Data 3.1 Use of Customer Data By using the Service, you grant ProofVibe the right to collect, use, and process data from your customers or website visitors (“Customer Data”) to provide and improve the Service.

3.2 Your Responsibilities You are responsible for ensuring that Customer Data is collected lawfully and complies with all applicable privacy laws. ProofVibe is not liable for your failure to comply with these obligations.

3.3 Data Security ProofVibe implements reasonable security measures to protect Customer Data but cannot guarantee absolute security.

  1. Fees and Payment 4.1 Subscription Fees You agree to pay all fees associated with your use of the Service. Fees are non-refundable unless otherwise stated.

4.2 Automatic Renewal Subscriptions automatically renew unless canceled before the next billing cycle.

4.3 Payment Information You must provide accurate payment information and authorize ProofVibe to charge your payment method.

4.4 No Refund Policy All fees are non-refundable, except where required by law. By using the Service, you acknowledge and agree that no refunds will be issued under any circumstances.

  1. Privacy Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.
  2. Intellectual Property All content and materials on the Service, except User Content, are owned by ProofVibe and protected by intellectual property laws. You may not use, copy, or distribute any content without our permission.

  4. Indemnification You agree to indemnify ProofVibe against any claims, damages, or losses arising from your use of the Service, violation of this Agreement, or infringement of any third-party rights.
  5. Disclaimer of Warranties The Service is provided “as is” without warranties of any kind. ProofVibe does not guarantee that the Service will be error-free, secure, or uninterrupted.
  6. Limitation of Liability ProofVibe is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the past 12 months.
  7. Governing Law and Dispute Resolution This Agreement is governed by the laws of India. Any disputes will be resolved through binding arbitration in Maharashtra, India, and you waive the right to participate in class actions or jury trials.

  • Assignment: You may not assign this Agreement without our consent.
  • Changes to Agreement: ProofVibe may update this Agreement and will notify you of material changes.
